IWS Privacy Policy

1.General

The use of our websites www.metior-solutions.com, www.metior-solutions.de and www.metior-solutions.co.za (collectively, the “Site”) is governed by IWS’s General Terms and Conditions of Use (“User Agreement”) and this Privacy Policy.

This Privacy Policy serves to inform the User (hereinafter also referred to “you”) about what information IWS collects and how the information you provide is utilised. IWS will undertake appropriate efforts to protect your personal data using technology capable to provide you a private and safe online environment. In handling your personal data, IWS adheres to the common law and Section 14 of the South African constitution. This privacy policy is governed by the Laws of the Republic of South Africa and without regard to the conflict of laws principle. Any cause of action that may arise under this privacy policy shall be commenced and be heard in the competent court in South Africa. You agree to submit to the personal and exclusive jurisdiction of the courts located within South Africa.

2. Implied Acceptance of IWS Privacy Policy by use

By using IWS’s Site and Services, or otherwise providing your personal data to IWS, you signify your acceptance of IWS privacy policy and agree to abide by its provisions. If you do not agree to this policy, please do not use our Site or provide any personal data to IWS and discontinue immediately any further use.

3. Type of Data and Collection methods

A. Personal data actively submitted by you

When you register on IWS Site and make use of its Services IWS needs to collect certain information about you in order to provide you with the services you have requested.

This information may include, but is not limited to, personal details such as: Name, Email Address, Business or Home Address, Employer/Affiliated Organisation, Contact Telephone Numbers, Date of Birth, Reason for Accessing Site, Intended Usage of Information Requested. IWS will also collect the Username (your email address by default) and Password you create for your account. In each such instance, you will know what data IWS collects through its site, because you actively submit it to IWS.

Once you choose to register with IWS and provide IWS with the requested personal data, it will be solely used for the purposes of providing you with the requested service and in conformity with the provisions of the Electronic Communications and Transactions Act 25/2002 of South Arica. IWS may also use your personally identifiable information to inform and/or contact you for your opinion on current services or for other potential products/services available from IWS.

Access to personal data held by IWS may also be requested. The South African Promotion of Access to Information Act, No. 2 of 2000 sets out the conditions and procedures for such a request and under what circumstances such access shall be granted.

Personal data given to IWS may be transmitted across state and country borders for the purposes of data consolidation, storage and simplified customer information management. By using our Site and providing us with your personal data, you consent to such transmission of your personal data.

B. Passively Tracked Information

Certain non-personal information may be collected while you are making use of IWS’s Site. This will comprise of data about usage and service operation that is not associated with a specific personal identity. IWS may collect and use this non-personal information to evaluate how the IWS Site is being used.

4. Use of Information by IWS

IWS will not share personal data with third parties unless required by law enforcement action, subpoena, or local law and/or in the following limited circumstances:

  • IWS has your consent. We require opt-in consent for the sharing of personal data.
  • IWS may share or transfer your personal data in connection with a prospective or actual sale, merger, transfer or other reorganisation of all or parts of our business. We will ensure the confidentiality of any personal data involved in such transactions and provide notice before personal information is transferred and becomes subject to a different privacy policy.
  • IWS may use other third parties such as an email service provider to send out emails on our behalf, and a payment processing company to bill you for services. However, we solely share the personal data we collect with the third parties for the purposes of providing that service.
  • IWS reserves the right to disclose your personally data as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process.
  • IWS reserves the right to use and disclose any information collected via the site that is not in personally identifiable form.

IWS collects passively submitted data and use these technologies primarily to identify our Customers, to help diagnose problems with our server, for purposes of administering, protecting and improving our Site and our systems, to better understand the preferences of our Site visitors, to compile aggregated statistics about site usage, and to help personalise your experience on our Site. IWS therefore uses all passively tracked information to provide you with the services you request and to help us better understand your needs and interests in the future.

5. Data Storage and Retention

IWS will retain your personal data for as long as your account is active and/or as needed to provide you with the Services you have requested. If you wish to cancel your account or request that we no longer use your information to provide you with the requested Services contact us at info@metior-solutions.com. IWS will retain and use your information only as necessary to comply with our legal obligations, resolve disputes, and exercise rights under our agreements.

6. Security Measures to Protect Your personal data

IWS undertakes reasonable measures to protect the personal data you provide us with. These measures include, but are not limited to preventing unauthorised access or disclosure, maintaining data accuracy, and ensuring the appropriate use of the data. IWS follows generally accepted business standards to protect the personal data submitted to IWS, both during transmission and once IWS receives it. We use SSL Encryption and store all our data on multiple servers for backup. No method of transmission over the Internet, or method of electronic storage, is 100% secure or free of error or defect, however. Therefore, while IWS strives to use commercially acceptable means to protect your personal data, IWS cannot guarantee its absolute security.

7. Anti SPAM Policy

IWS and all its Customers acknowledge and agree to never initiate or engage otherwise in any SPAM emailing. You shall notify IWS, if you become aware of such activities affecting the use of IWS’s sites and services.

8. Links to Third Party Web Sites

IWS’ Site may contain links to Internet sites and services that are maintained by third parties. Those sites may have different privacy and security policies / practices. IWS has no influence or control over those sites and its policies / practices and must not be held responsible or liable for them. When you visit any site outside the IWS Site the IWS Privacy Policy is no longer applicable.

9. Changes to this Policy

IWS may update this privacy policy occasionally to reflect changes to our information practices. IWS will notify you with respect to substantial changes by email (sent to the latest e-mail address specified in your account) and/or by means of an update notice posted on the Site, prior to the change becoming effective. You should regularly review the Site for the latest status of our privacy policy.
